Agreement to terms

By accessing or using BrandAndGo, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service. BrandAndGo is operated by Fintech Development Pty Ltd (ACN 655 608 969, ABN 78 655 608 969), an Australian company.

Description of service

BrandAndGo is a brand management and social publishing platform. The service includes brand profile management, multi-platform social publishing, AI-powered content generation, competitor intelligence, content calendar and scheduling, asset management, and team collaboration tools.

Account registration and security

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at our contact form if you suspect unauthorised access to your account.

Acceptable use

You agree not to:

• Use the service to send spam or unsolicited messages via connected social platforms.
• Publish content that is illegal, defamatory, or infringes on third-party intellectual property rights.
• Abuse AI content generation features to produce misleading, harmful, or deceptive content.
• Upload a photo, video, or voice recording of any person, or generate images, video, or audio that depicts or imitates a real person, without that person's consent. You warrant that you hold all necessary rights and permissions for every individual whose likeness or voice you upload, reproduce, or generate using the service, and you are responsible for obtaining and keeping proof of that consent.
• Create "deepfakes" or otherwise use the AI likeness, presenter, or voice-cloning features to impersonate a person, brand, or organisation, or to mislead others about who is speaking or appearing in the content.
• Attempt to access other users' data, reverse-engineer the platform, or circumvent security measures.
• Use the service in any way that violates applicable Australian law.

Subscription and billing

BrandAndGo offers a free tier and paid subscription plans. The Starter, Professional and Business plans include a 14-day free trial. A valid payment method is required to start a trial, and you are not charged during it. When the trial ends, your selected plan is charged automatically via Stripe unless you cancel first. We email you before the trial ends so the charge is never a surprise. You may cancel at any time, during the trial or after, from Manage subscription in your billing settings. Cancelling during the trial means you are never charged. After the trial, cancelling retains your access until the end of the current billing period, and refunds are not provided for partial billing periods. The Agency and Enterprise plans are arranged directly with us and are not sold through self-service checkout.

• Free trials: A trial is available once per business. We tell you the end date before it arrives.
• The account holder: Each account has one account holder, shown in your settings. The role can be transferred, and only the account holder can cancel a subscription.
• When paid access ends: When a trial ends, a subscription is cancelled or not renewed, or a payment finally fails, the account becomes a free Personal account belonging to the account holder on that date. Everyone else in the account loses access until a paid subscription is in place again. The account holder can keep using what they created, within the free plan's limits, and can view and download everything the business has created.
• Nothing is deleted on that date: Anything beyond the free plan's limits becomes read only, and you can export it for at least 30 days. We give you that deadline as a calendar date. Subscribe again within it and everything, and everyone, is restored.
• What we have charged you for, we deliver: Posts already published stay published, and anything already sent to a social platform is not recalled. Posts already scheduled on that date still go out, because they were paid for when they were created. You cannot schedule new posts beyond that date, and work that has not started does not start.
• Credit packs you have bought stay usable by the account holder until they expire.

Intellectual property

You retain ownership of all content you create and upload to BrandAndGo. By using the service, you grant us a limited licence to store, process, and display your content as necessary to provide the service. BrandAndGo, including its design, code, and branding, is the intellectual property of Fintech Development Pty Ltd.

Third-party integrations

BrandAndGo connects to third-party social platforms including Facebook, Instagram, LinkedIn, X, and YouTube. You are responsible for complying with the terms of service of each platform you connect. We are not responsible for changes to third-party platform APIs or policies that may affect functionality.

Data sovereignty

All data is stored and hosted exclusively in Australia, in the Google Cloud Platform australia-southeast1 (Sydney) region, and data at rest never leaves Australia. We are committed to maintaining Australian data residency for all customer data. Some AI-powered features send your inputs to specialist providers that process them overseas under data-protection agreements consistent with Australian Privacy Principle 8; those providers do not train on your data. Text generation currently processes in the United States. Image generation uses Google's global endpoint, which may process in any region Google operates, because no image model is offered in Australia.

Limitation of liability

To the maximum extent permitted by Australian law, BrandAndGo and Fintech Development Pty Ltd are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid us in the twelve months preceding the claim.

Termination

We may suspend or terminate your account if you violate these terms. You may close your account at any time by contacting us. Upon termination, we will delete your data in accordance with our Privacy Policy.

Governing law

These terms are governed by the laws of Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of the Northern Territory, Australia.
