Agreement to terms

By accessing or using BrandAndGo, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service. BrandAndGo is operated by Interetail Pty Ltd, an Australian company.

Description of service

BrandAndGo is a brand management and social publishing platform. The service includes brand profile management, multi-platform social publishing, AI-powered content generation, competitor intelligence, content calendar and scheduling, asset management, and team collaboration tools.

Account registration and security

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at our contact form if you suspect unauthorised access to your account.

Acceptable use

You agree not to:

• Use the service to send spam or unsolicited messages via connected social platforms.
• Publish content that is illegal, defamatory, or infringes on third-party intellectual property rights.
• Abuse AI content generation features to produce misleading, harmful, or deceptive content.
• Attempt to access other users' data, reverse-engineer the platform, or circumvent security measures.
• Use the service in any way that violates applicable Australian law.

Subscription and billing

BrandAndGo offers a free tier and paid subscription plans. Paid plans include a 14-day free trial. After the trial period, your selected plan will be charged automatically via Stripe. You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. Refunds are not provided for partial billing periods.

Intellectual property

You retain ownership of all content you create and upload to BrandAndGo. By using the service, you grant us a limited licence to store, process, and display your content as necessary to provide the service. BrandAndGo, including its design, code, and branding, is the intellectual property of Interetail Pty Ltd.

Third-party integrations

BrandAndGo connects to third-party social platforms including Facebook, Instagram, LinkedIn, X, and YouTube. You are responsible for complying with the terms of service of each platform you connect. We are not responsible for changes to third-party platform APIs or policies that may affect functionality.

Data sovereignty

All data is stored and hosted exclusively in Australia, in the Google Cloud Platform australia-southeast1 (Sydney) region, and data at rest never leaves Australia. We are committed to maintaining Australian data residency for all customer data. Some AI-powered features send your inputs to specialist providers that may process them overseas (currently the United States) under data-protection agreements consistent with Australian Privacy Principle 8; those providers do not train on your data.

Limitation of liability

To the maximum extent permitted by Australian law, BrandAndGo and Interetail Pty Ltd are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid us in the twelve months preceding the claim.

Termination

We may suspend or terminate your account if you violate these terms. You may close your account at any time by contacting us. Upon termination, we will delete your data in accordance with our Privacy Policy.

Governing law

These terms are governed by the laws of Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of the Northern Territory, Australia.
